A Binding Financial Agreement following separation or divorce is an agreement between two parties providing how any or all of the property or financial resources of both parties is to be dealt with.  This agreement will deal with the parties property and liabilities, superannuation; and spousal maintenance. This agreement does not cover child support.   It is a critical element for the validity of all binding financial agreements that both parties are provided with independent legal advice from their own respective Australian legal practitioners.  This must happen before the parties sign the BFA.
