SOLICITOR CONSULTATION SUMMARY
Matthew Geoffrey Eyles
Family Court Parenting Matter + NSW ADVO Matter
Purpose of appointment
I need urgent legal advice and representation regarding ongoing Federal Circuit and Family Court parenting proceedings and related NSW ADVO proceedings involving Amanda Eyles. I need help organising evidence, understanding the strongest legal pathway, and protecting my relationship with my son MJ.
1. Who I am
My name is Matthew Geoffrey Eyles.
I am the father of MJ, born 28 July 2014.
There are current parenting proceedings in the Federal Circuit and Family Court of Australia, file number NCC2176/2022.
Final parenting orders were made on 9 May 2024. My understanding is that those orders provide for shared parental responsibility between myself and Amanda Eyles.
Amanda Eyles is my sister and MJ’s aunt/carer. She is also the protected person in the related ADVO proceedings.
2. Main issue
My main concern is that my parenting time and involvement with MJ have been significantly reduced since July 2025, while ADVO and police processes have overlapped with the parenting dispute.
I need advice about whether parenting arrangements have effectively been changed without proper Family Court variation, and how the ADVO proceedings affect my parenting rights and obligations.
3. Short timeline
• 9 May 2024 – Final parenting orders made.
• Before July 2025 – Regular and substantial time with MJ.
• 11 July 2025 – Conflict escalated around passport paperwork and parenting arrangements.
• After July 2025 – Communication deteriorated and parenting time reduced.
• Late 2025 to 2026 – Further disputes involving parenting time, school involvement, medical information, and police material.
• April 2026 – Interim Family Court issues including procedural fairness concerns and hearing difficulties.
4. What I need advice on
1. Interaction between the ADVO and Family Court parenting orders.
2. Reduction of parenting time.
3. Possible applications to restore or increase time.
4. Procedural fairness issues.
5. Organising evidence effectively.
6. Responding to allegations.
7. Access to school and medical information.
8. Possible misuse or dissemination of restricted material.
9. What I should stop doing immediately.
10. The strongest legal strategy moving forward.
5. Evidence I have
• Final parenting orders
• ADVO paperwork
• Police material
• Text messages
• Emails
• School records
• Medical/professional correspondence
• Child Impact Report material
• Court orders and hearing material
• Communication with solicitors and the ICL
• Chronology documents
• Evidence regarding parenting time before and after July 2025
6. My position
I accept that the matter is complicated and emotional.
I also accept there may have been times where I over-communicated because I was distressed about losing time with my son.
However, my position is that my communications were primarily attempts to discuss parenting arrangements, comply with court orders, and remain involved in MJ’s life.
I deny intending to harass, intimidate, threaten, or cause fear to Amanda.
My priority is maintaining a safe, stable, meaningful relationship with MJ and reducing conflict where possible.
7. What I need from the solicitor
• Review the current orders and ADVO conditions
• Identify strongest and weakest legal points
• Help organise evidence
• Advise whether urgent Family Court action is needed
• Advise regarding ADVO crossover issues
• Assist with affidavit and evidence preparation
• Provide clear strategic advice
